What happens when an employee changes their name or gender?
No: telling HMRC about a name change is the employee's job, not the employer's. Here's how to update your name for PAYE, Self Assessment and payroll.
No, your employer does not tell HMRC when you change your name. It is the individual’s own responsibility to notify HMRC and to update their PAYE, National Insurance and Self Assessment details. As the employer, you update your own payroll records so the correct name appears on payslips and in your RTI submissions, but the employee still has to tell HMRC directly.
Who is responsible for telling HMRC?
If an employee has changed their given name, it is easy to assume that you, as their employer, must inform HM Revenue & Customs (HMRC) on their behalf. In fact, HMRC treats a name change as personal information that the individual has to report themselves.
That split matters. If the employee does not notify HMRC directly, the new name you hold in payroll will not match the record HMRC holds against their National Insurance number. Mismatched records can trigger HMRC queries, coding errors or duplicate records, so it is worth reminding staff to do their part.
How an employee tells HMRC of a name change
HMRC has made this straightforward, and it no longer involves any paper form for a simple name change. An employee can notify HMRC of a name change in any of these ways:
- Use the Tell HMRC about a change to your personal details service online (they will need to sign in with their Government Gateway details, or set them up).
- Report it through the HMRC app.
- Sign in to their personal tax account and update their details there.
If the employee is also registered for Self Assessment, reporting the name change updates their record for that too, so there is no need to notify twice.
To change your name on your National Insurance record, use the same personal-details service above; NI records are updated as part of the change to your HMRC details.
Updating a name in payroll (including after marriage)
One of the most common triggers is an employee who has recently married and taken a new surname. Here is the order of play:
- The employee tells HMRC using one of the methods above.
- You update your payroll software with the new legal name so it flows through to payslips and your Full Payment Submission (FPS).
- The corrected name is reported to HMRC in your next FPS as normal.
There is no separate “employee name change form” to send HMRC alongside your RTI return, and you should not wait for a specific point in the tax year: update the name in payroll from the effective date and let it feed through on the next pay run.
What about a change of gender?
This is handled sensitively and largely automatically. If an employee changes gender, HMRC will update their name and gender details automatically once their Gender Recognition Certificate is received by HMRC. The employee does not need to send a separate notification for the HMRC record, though you should still update your own payroll records to reflect their name.
